Enumerated Powers Act, H.R. 2458

The Enumerated Powers Act, H.R. 2458, requires that all bills introduced in the U.S. Congress include a statement setting forth the specific constitutional authority under which the law is being enacted. This measure will force a continual re-examination of the role of the national government, and will fundamentally alter the ever-expanding reach of the federal government.

Respecting the Tenth Amendment, which reserves all powers not granted to the national government to the states, or the people, will ensure that the Constitution continues to truly guide our nation.

  1. Isn't this the role of the judicial branch, post facto? This would fundamentally constrict the ability of the legislature to perform its stated function within the Constitution...

  2. Hey Rupert thanks for the post! I agree with you 100%, it IS the judicial branches job to ensure that what the legislature passes is constitutional. However, I personally believe that the legislature is not doing its job. No where in the Constitution does it say that the government is allowed to own stake in private companies. Yet, there has been no outcry from the judicary. Therefore, the check and balance is not there. I feel that this bill will force congress to rethink their pork-filled legislature.
